Welcome to Villa Silencio! These Terms and Conditions apply to all bookings and stays at our villa located in El Romo, Comares, Málaga, Andalusia, Spain. They are intended to provide clarity to both you and us and to help avoid misunderstandings. By making a reservation, you agree just as we do to the terms outlined below.

1. Bookings and Payments

• Reservations are only considered confirmed upon receipt of a 50% deposit and writtenconfirmation from Villa Silencio.

• The remaining 50% must be paid no later than 6 weeks prior to the arrival date.

• For bookings made within 6 weeks of arrival, the full amount must be paid immediately upon booking and is considered final.

• Prices include local taxes unless otherwise stated.

• Payments can be made by bank transfer or other agreed-upon payment methods.

• All rates include tapwater, electricity, Wi-Fi, linen, and standard amenities and are VAT (IVA) exempt unless otherwise indicated.

2. Cancellations

• Cancellations must be submitted in writing (via email to [email protected]).

• Cancellations up to 12 weeks prior to arrival are subject to a cancellation fee of 25% of the totalrental amount (equivalent to 50% of the deposit).

• Cancellations up to 6 weeks prior to arrival incur a cancellation fee of 50% of the total rentalamount (equal to 100% of the deposit).

• No refunds are possible for cancellations within 6 weeks of arrival.

• No refunds will be issued for no-shows or early departures.

• We strongly recommend purchasing travel and cancellation insurance.

3. Arrival and Departure

• Check-in is from 16:00; check-out is no later than 10:00 to allow time for thorough cleaning.

• Early check-in or late check-out is possible upon request and subject to availability.

4. Stay & Liability

• Villa Silencio accommodates up to 8 adults. Children are welcome only by prior arrangement and must be supervised by someone aged 18 or older.

• Smoking is not permitted inside the villa. Outdoor smoking is allowed only with proper use of ashtrays and safe disposal due to the dry environment.

• Pets are only allowed with prior written approval.

• Parties or events are not permitted without explicit permission.

• Guests must respect the tranquil and natural setting of Villa Silencio. Disturbances to neighbors, wildlife, or the environment may result in early termination of the rental agreement, at Villa Silencio’s discretion.

5. Damage and Security Deposit

• Accidents can happen. Any damage to the villa, terraces, garden, or inventory must be reportedimmediately to the Villa Silencio team.

• A security deposit of €1,250.00 must be paid no later than 6 weeks before arrival. It will be refunded as soon as possible, within 14 days after departure, provided no damage is found.

• Any damage or loss will be deducted from the deposit.

• If the damage exceeds the deposit, we reserve the right to invoice the additional amount.

6. Availability and Prices

• Offers are non-binding and subject to change. All listings on the website are subject to interim updates. Once your booking is confirmed, the agreed price is guaranteed, regardless of anylater changes.

• Villa Silencio is not legally responsible for apparent errors or omissions on third-party websites. If you notice an error, we would greatly appreciate your feedback.

7. Safety and Responsibility

• You and your fellow guests are responsible for your own safety during your stay, especiallywhen using the pool, stairs, open flames, kitchen appliances, utensils, glassware, cooktop, and barbecue.

• Villa Silencio is not liable for loss, theft, injury, damage, or expenses incurred during your stay.

• A first aid kit, fire and carbon monoxide detectors, and fire extinguishers are provided.

• Guests are responsible for locking all doors, windows, and the entrance gate upon departure. Keys should be stored in the key safe at the entrance.

• Guests are responsible for supervising minors.

• For safety reasons, glassware is not allowed in or around the pool. Please use the providedplastic cups stored on the kitchen island shelves.

• In case of fire, immediately call 112 to minimize damage and ensure your safety.

8. Weather Conditions and Force Majeure

• Villa Silencio cannot be held responsible for inconvenience caused by weather conditions, natural disasters, power or water outages, pandemics, government measures, or other force majeure situations beyond our control. We reserve the right to reschedule or cancel bookingswithout liability.

9. Use of Facilities

• All facilities, including the heated pool (available from March 1 to November 1), air conditioning, Wi-Fi, and barbecue, are included unless otherwise stated. Use is based on reasonable, environmentally responsible behavior.

• For example, air conditioning should only be used when present in the villa and turned off when absent. The system is powerful enough to quickly adjust temperatures upon return.

• The heated pool has an insulating cover, which should be rolled out in the evening to retain heat.

• To prevent insects from entering the villa, screen doors must be closed after use.

10. Personal Data

• Guests agree to the processing of their personal data for reservations, administration, and tourist registration. See our Privacy Policy for details.

11. Governing Law

• These terms are governed by Spanish law.

• Any disputes will be submitted to the competent court in Málaga, Spain.

12. Fire Risk, Open Flames, and Fireplace

• From 1 June to 15 October, barbecuing or making open fires is legally prohibited due to firehazard.

• Outside this period, any open flame must be supervised and used safely.

• The indoor fireplace may only be used with bio-ethanol. Burning wood is not allowed due to smoke risks.

13. Terms for Business Guests

• Guests must indicate at the time of booking whether the stay is for business purposes.

• Additional facilities may be provided upon request and subject to availability.

• Business guests are responsible for managing their own VAT-related administration.

14. Intellectual Property Protection

• This website and its content are the intellectual property of Villa Silencio. Reproduction or distribution—regardless of medium—for any purpose requires prior written consent.

• The use of Villa Silencio's brand names and logos is not permitted without prior writtenpermission.

15. Technical Availability

• Villa Silencio strives for optimal website usability and accessibility. Should a technical issue arise, rest assured that we will resolve it as quickly as possible.

16. Content

• Villa Silencio is not responsible for content on the website based on third-party sources, including information about tourist attractions, events, or local points of interest.
